2. Definitions

For the purposes of this Website Legal Framework and unless otherwise expressly stated, the following terms shall have the meanings set out below:

3. Scope and Purpose

Nothing in this document limits mandatory rights granted under applicable consumer protection or data protection legislation.

4. Eligibility

Customers must be at least 18 years old and legally capable of entering into binding contracts.

By placing an Order, the Customer confirms compliance with this requirement.

5. Products and Availability

The Company makes reasonable efforts to ensure accuracy of descriptions and pricing.

Minor differences (e.g., color variation due to screen settings) do not constitute defects.

Availability is subject to stock.

6. Pricing and Payment

All prices include VAT unless stated otherwise.

Payment must be completed prior to dispatch.

The Company may suspend or refuse an order where there are reasonable grounds to suspect fraud, abuse, or unauthorized activity.

In the event of an obvious pricing error, the Company shall not be bound by the incorrect price and reserves the right to cancel the Order prior to dispatch.

7. Order Process and Contract Formation

The Customer places an Order through the Website.

The Order constitutes an offer to conclude a Contract.

The Contract is concluded only upon explicit Order confirmation by the Company (e-mail confirmation or dispatch confirmation).

Automatic receipt confirmation does not constitute acceptance.

The Company reserves the right to refuse Orders due to pricing errors, technical issues, stock unavailability, or suspected fraud.

8. Delivery

Risk transfers to the Customer upon physical possession of the Goods.

Ownership transfers upon full payment.

If delivery fails due to incorrect information, refusal without legal grounds, or non-collection, the Company may deduct return and handling costs from the refund to the extent permitted by law.

9. Right of Withdrawal (EU Consumers)

Consumers have the right to withdraw within 14 days without giving any reason.

The withdrawal period expires 14 days after physical possession of the Goods.

To exercise withdrawal, the Customer must send a clear statement to the Company.

Goods must be returned within 14 days of withdrawal notice.

The Customer shall bear the direct cost of returning the Goods unless otherwise agreed.

Refunds may be withheld until returned Goods are received and inspected.

The Company may reduce the refund to reflect any diminished value of the Goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning.

9.1 Hygiene-Sensitive Goods

In accordance with Article 16(e) of Directive 2011/83/EU, the right of withdrawal does not apply to sealed Goods that are not suitable for return for health protection or hygiene reasons once unsealed.

For intimate garments, underwear, swimwear, and similar Goods:

Removal or damage of hygiene seals, liners, tags, or signs of wear may void the right of withdrawal.

The Customer is liable for diminished value resulting from handling beyond what is necessary to assess nature and characteristics.

If returned Goods are unsellable for hygiene reasons, refund may be refused to the extent legally permitted.

10. Legal Guarantee

Consumers benefit from a minimum two-year legal guarantee under EU law.

In case of non-conformity, the Customer is entitled to repair, replacement, price reduction, or termination in accordance with applicable law.

11. Abuse of Rights

The Company may refuse future transactions where there is objective evidence of abuse of consumer rights, fraudulent conduct, or systematic excessive returns, in compliance with applicable law.

Any refusal shall be proportionate, objective, and non-discriminatory.

12. Intellectual Property

All Website content is owned or licensed by the Company and protected by law.

13. Technical Limitations

The Company does not guarantee uninterrupted or error-free operation of the Website.

The Company shall not be liable for temporary unavailability of the Website, system failures, technical malfunctions, connectivity issues, maintenance interruptions, cybersecurity incidents, or errors caused by third-party service providers beyond the Company’s reasonable control.

Where liability cannot be excluded, it shall be limited to the amount paid by the Customer for the relevant Goods, Services, or transaction giving rise to the claim.

15. Force Majeure

The Company shall not be liable for failure or delay in performing its obligations due to events beyond its reasonable control, including but not limited to:

  • natural disasters,
  • governmental actions or restrictions,
  • war, civil unrest, or strikes,
  • cyberattacks or large-scale technical failures,
  • telecommunications or utility disruptions.

Performance of obligations shall be suspended for the duration of such event.

16. Severability and No Waiver

If any provision of this document is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.

Failure by the Company to enforce any right or provision shall not constitute a waiver of such right or provision.

17. Amendments

The Company reserves the right to update or amend this document at any time.

The version published on the Website at the time of the relevant transaction shall apply unless otherwise required by mandatory law.

Amendments shall not affect Contracts already concluded unless required by mandatory law.

Any disputes arising out of or relating to this document shall be subject to the competent courts of Lithuania, without prejudice to the right of consumers to bring proceedings in their country of residence in accordance with applicable EU law.

Nothing in this section limits statutory rights that cannot be excluded under applicable legislation.

Consumers may also submit disputes through the European Commission’s Online Dispute Resolution platform (ODR).
